Artist Agreement and Waiver of Liability
Originality: I, the undersigned artist, certify that the art that I am submitting is my original art and that I am the author and creator of such art. If I have used AI in the development of my artwork, it is disclosed within the application.
Promotion and Publicity: I grant City of Eugene permission to publish in all media my name, artwork, location and submitted photos for use in promotion through print media, television and the internet. I further allow City of Eugene to release such information to other persons and entities. My name will be attributed to my pieces that are shown by City of Eugene.
Responsibility: Artists are always encouraged to have insurance in general, to protect themselves and their work. City Exhibitions artwork installations are insured by City of Eugene. Artists are required to submit a list of all works exhibited, including title, medium, date and value to Cultural Services prior to the exhibition.
Artwork remains in the gallery until the end of the exhibit; I understand that if my artwork is accepted for the show then the work may not be removed from the exhibition until the pickup date described in the Call for Art. It is my responsibility to notify City of Eugene in writing or by email of a third-party pickup of artwork at the conclusion of the exhibition. Artwork accepted by the judges, if sold prior to the exhibit, must be placed in the show. Replacement pieces are not accepted.
Hang-Ready: I confirm my two-dimensional artwork is ready to hang, includes D-rings and sturdy hanging wires. I acknowledge that the D-rings may be adjusted by staff during installation to accommodate the proper hanging of artwork. If my work has special considerations for hanging, I will notify Public Art staff prior to intake.
Acceptance of artwork: I acknowledge that City of Eugene reserves the right to accept or deny any submission at any point in the process.
Indemnification: Artist shall indemnify and hold City, and its officers, agents and employees, harmless from and against all claims, actions, liabilities and costs, including attorney fees and other costs of defense, arising out of the acts, errors or omissions, whether alleged or actual, of Artist, its subcontractors, agents and employees in performing or failing to perform the Services, failing to strictly comply with any provision of the Contract or any other actions or failures to act by Artist and Artist’s employees, agents and subcontractors. In the event any such action or claim is brought against City, Artist shall, if City so elects and upon tender by City, defend the same at Artist’s sole cost and expense, promptly satisfy any judgment adverse to City or to City and Artist, jointly, and reimburse City for any loss, cost, damage or expense, including attorney fees, suffered or incurred by City. City shall notify Artist, within a reasonable time, of any claim, threat of claim or legal action.
